The SkillShare program is supported by Oxfam Australia and is provided to you ("User") under the following terms and conditions and any operating rules or policies that may be published by SkillShare. By completing the registration process, you are indicating your agreement to be bound by all of these terms and conditions. If you do not agree to these terms and conditions, you may not register.

Unlawful or prohibited use
By using this site, you warrant to SkillShare that you will not use this site, or any of the content obtained from this site, for any purpose that is unlawful, intentionally or unintentionally, or prohibited by these terms. If you violate any of these terms, your permission to use this site automatically terminates.

Registration obligations
When requested, each User must: (1) personally provide true, accurate, current and complete information on this site's registration form (collectively, the "Registration Data") and (2) maintain and promptly update the Registration Data as necessary to keep it true, accurate, current and complete.
Each User will receive passwords and account designations on completing this site's registration processes and is wholly responsible for maintaining the confidentiality of these details. SkillShare is not liable for any loss or damage arising from a User's failure to comply with this, including any loss or damage arising from any User's failure to: (1) immediately notify SkillShare of any unauthorised use of his or her password or account or any other breach of security; and (2) ensure that he or she exits from his or her account at the end of each session.

Termination of accounts
SkillShare may terminate a User's account on this site at SkillShare's absolute discretion and for any reason. SkillShare is especially likely to terminate for reasons that include, but are not limited to, the following:
(1) violation of these terms;
(2) abuse of site resources or attempt to gain unauthorised entry to the site or site resources;
(3) use of this site in a manner inconsistent with the purpose;
(4) a User's request for such termination; or
(5) as required by law, regulation, court or governing agency order.

SkillShare shall not be liable to any User or other third party for any termination of that User's access or account hereunder. In addition, a User's request for termination will result in deactivation but not necessarily deletion of the account. SkillShare reserves the right to delete, or not delete, a User's account at SkillShare's sole discretion, as well as to delete, or not delete, content at SkillShare's sole discretion.

Privacy
SkillShare will endeavour to ensure that all information provided by you is kept safely and securely and is only disclosed as necessary in order to undertake the activities associated with SkillShare's core aims (i.e. matching Volunteers and Not-For-Profits). E-mail
SkillShare uses e-mail as a means to communicate news, events and new Project Volunteer roles. Users may 'opt out' of receiving these e-mails by contacting us at any time.

Updated Term and Conditions
From time to time we will need to update our Terms and Conditions. The most current version (which will replace each previous version and be legally binding) will always be available to view here on the website. Please note that you can unsubscribe from this service at any time and may contact us at any time if you have any concerns or questions.

Not-For-Profit Agreement (for those registering their Not-For-Profit group)

On behalf of my Not-For-Profit I certify that:
1. the information given in this application is true and correct.
2. we agree to the SkillShare website terms and conditions.
3. we agree to acknowledge the assistance of SkillShare in all promotional material associated with the Project and will seek prior approval of any such materials with the SkillShare Management Team.
4. we will make all appropriate information about the Project available to the SkillShare Volunteer(s).
5. we agree to report to the SkillShare Management Team on the progress and outcomes of the Project.

I further note that our Not-For-Profit notes and accepts that:
1. the SkillShare Volunteers participating in the Project do so as Volunteers, not as representatives of their own employer(s) and not as agents of Oxfam Australia
2. this Volunteer status means that any advice provided by the Volunteers is informal, so that where critical matters are involved we may need to seek formal professional advice.
3. any SkillShare Volunteers working on this Project will be treated as Volunteers of the organisation for insurance purposes.
4. wherever possible, SkillShare promotes its Projects and Project partners through their website, Annual Report, newsletters and other public forums. Please inform SkillShare if you do not want your organisation or Project mentioned in any of these forums.
5. SkillShare takes great care when selecting Volunteers and sights the professional resume or background of Volunteers. However, SkillShare does not guarantee, and takes no responsibility for, the skills or character of any SkillShare Volunteer.
6. It is the sole responsibility of the Not-For-Profit to carry out the appropriate Police and Working with Children Checks in relation to any SkillShare Volunteer. SkillShare takes no responsibility for the conduct of these Checks.
7. SkillShare expressly disclaims any liability in negligence or otherwise in relation to any advice provided by a SkillShare Volunteer, or in relation to any other action undertaken by a SkillShare Volunteer while assisting the Not-For-Profit.
8. The Not-For-Profit undertakes to independently assess any advice given by a SkillShare Volunteer to the Not-For-Profit, and accepts full responsibility for any actions taken by the Not-For-Profit in reliance on such advice.

VOLUNTEER AGREEMENT (for those registering as Volunteers)

SkillShare is run and resourced solely by Volunteers so Volunteer contribution is greatly appreciated. The time and skills contributed by Volunteers make the goals of SkillShare achievable. Together, we are actively helping to create a world which is fair, where justice is possible and in which poverty can become history.

This Agreement for SkillShare Volunteers sets out the terms by which all Volunteers are required to engage with SkillShare.

1. Use of personal information
SkillShare’s use of personal information is governed by the SkillShare Privacy Policy. In addition, Volunteers engaging with SkillShare agree that:
i) Volunteer information may be accessed by the Oxfam Australia National Volunteer Coordinator to fill skilled Volunteer requirements within Oxfam Australia.
ii) when a Volunteer is matched to a Project, their email and telephone contact details will be passed to the Monitor. Likewise the email and telephone contact details of Monitors will be passed to the relevant Volunteers and Not-For-Profit organisation.

2. Selection and induction
All Volunteers who join the Volunteer database must first complete a selection and induction process.

3. Assignment
Volunteers contribute on a periodic basis depending on Project requests and Volunteer availability. Each Project will be slightly different and the specific requirements of each will be agreed to in the Project Agreement.

4. Promotion of SkillShare’s Interests
SkillShare Volunteers shall best endeavour to promote and enhance the interests, welfare, business, profitability, growth, and, reputation of SkillShare and any relevant parties/programs; and not intentionally act contrary to the interests of SkillShare or Oxfam Australia.

5. Confidential Information
SkillShare Volunteers shall not, except as authorised by the Executive Director, use for their own benefit or gain or divulge to any persons, company or other organisations whatsoever any confidential information relating to their affairs or dealings with SkillShare, Oxfam Australia or clients of SkillShare. This restriction shall cease to apply to any information or knowledge which may subsequently come into the public domain by way of authorised disclosure.

All confidential records, documents and other papers provided by SkillShare, Oxfam Australia or clients of SkillShare, together with any copies or extracts thereof, made or acquired by Volunteers during the course of their engagement shall remain the property of the relevant entity. “Confidential information” shall include all information which has been specifically designated as confidential and any information which relates to the commercial and financial activities of the organisation, the unauthorised disclosure of which would embarrass, harm, or discredit the organisation. It does not extend to information already in the public domain unless such information arrived there by unauthorised means.

6. Adherence to the Privacy Act
SkillShare’s Volunteers are required to abide by the Privacy Act. Volunteer responsibilities when dealing with personal information follow the 10 National Privacy Principles. The principles set the standard that SkillShare and Oxfam Australia are required to observe in collecting, storing, using, disclosing, protecting and transferring personal information.

The National Privacy Principles include:
1 Collection: describes what an organisation should do when collecting personal information.
2 Use and Disclosure: outlines how organisations can use and disclose personal information.
3 Data Quality and 4 Data Security: set the standards that organisations must meet for the accuracy, currency, completeness and security of personal information.
5 Openness: requires organisations to be open about how they handle personal information.
6 Access and correction: gives people a general right of access to their own personal information, and the right to have that information corrected, if it is inaccurate, incomplete or out of date.
7 Identifiers: says that generally, Commonwealth government identifiers (such as the Medicare number or the Veterans Affairs number) can only be used for the purposes for which they were issued.
8 Anonymity where possible, requires organisations to provide the opportunity for people to interact with them without identifying themselves.
9 Transborder Data Flows: outlines privacy protections that apply to the transfer of personal information out of Australia.
10 Sensitive Information: requires consent when an organisation collects sensitive information about a person such as health information, or information about racial or ethnic background, or criminal record. Sensitive information is a subset of personal information and special protection applies to this information.

7. Copyright and Intellectual Property
You assign to SkillShare or SkillShare’s client as relevant, and will procure the assignment to SkillShare (or SkillShare’s client) of, all copyright (including future copyright), trade mark, design, patent, circuit layout rights and all other intellectual property rights (the rights) in any and all designs, drawings, documents, software developments, computer programs, knowhow, processes, circuit layout rights, confidential information, inventions, prototypes and any other items and things produced or created (at any time) by you or on your behalf in relation to the provision of your services to SkillShare or to any client of SkillShare (the works).

You also give your consent to, or if you are a company or other organisation you must procure from any of your employees, contractors, officers or agents who is an author of any work, a consent in writing to SkillShare, our licensees and successors in title and any other person authorised by us or our licensees and successors in title using the works for the purposes for which the material was created and for SkillShare’s business purposes, including exercising for any of those purposes all acts comprised in the copyright in the material, even if that use would otherwise infringe moral rights. You must ensure that any consents you procure are genuinely given and you must promptly provide SkillShare with written evidence of all such consents if required by SkillShare.

You will sign all documents and do anything reasonably required by SkillShare to give effect to the assignment of rights in this clause.

AGREEMENT FOR OXFAM AUSTRALIA VOLUNTEERS

Oxfam Australia greatly appreciates volunteer contribution. The time and skills contributed by Volunteers helps make the goals of Oxfam Australia achievable. Together, we are actively helping to create a world which is fair, where justice is possible and in which poverty can become history.

The Agreement for Oxfam Australia Volunteers sets out the terms by which all volunteers are required to engage with the agency.

1. Duration
The period that you will be engaged in volunteer activities for Oxfam Australia.

2. Assignment
As per your Position Description.

3. Promotion of Oxfam Australia’s Interests

6. Post Volunteering
Unless otherwise stated in law, for a period of two years from the date of termination of voluntary engagement, Oxfam Australia Volunteers shall be restricted, without written authority from the Executive Director, from disclosing or making use of any information in their knowledge or possession relating to the research, development or design of the program, or any information, including marketing or product plans, of a sufficiently high degree of confidentiality to amount to a trade or brand secret.

7. Acceptance
Clicking on the Terms and Conditions check box during registration will constitute acceptance.
